These conditions shall apply to all of the company's quotations, contracts and orders (including telephone orders), for the sale or supply of goods accepted by the company

Disclaimer of Warranties and Limitation of Liability
We are not obliged to supply the goods to you until we have confirmed acceptance of your order and this is when the contract is made. You do not own the goods until we receive payment in full.
- Distance Selling Regulations give you the right to cancel an order and return any goods that have not been installed or used, up to 7 working days from the date of delivery or before you receive your order. To do this, please e-mail us at shop@southforkracing.co.uk or write to us at the address shown above.
- If you cancel, you must return the goods to us at your own expense. You are responsible for the risk of loss or damage when you return goods, so you should take out enough postal insurance to cover their value. Please ensure packaging is adequate for return of post and where possible, please include all original packaging with the returned item.
- If you fail to return the goods, we will arrange collection of the goods at your expense, if you fail to take reasonable care of the goods before they are returned to us and this results in damage or deterioration, we may claim against you for breach of statutory duty.
This cancellation does not affect your legal rights – for example, if goods are faulty or misdescribed.
You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible and we will arrange for their return to us or the manufacturer at no cost to you.
Advice given by agents or servants of this company during telephone/Internet orders is based entirely upon information given by the purchaser. Where advice is given after visual inspection by agents or servants of this company, such advice shall amount to an opinion only and the company shall not accept liability for any inaccuracies. Additionally, goods supplied are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put.
Compatibility of goods is not guaranteed where modifications or alterations have been made and the company shall, in such circumstances, and at its discretion, issue a refund or credit to the purchaser.
No liability for failure can be accepted by this company for such alternative use, amendment or modification.
The company accepts no liability in respect of failure to supply or other interruptions caused by matters beyond the reasonable control of the company, including strikes, lockouts, civil disputes, acts of God, war or actions by third parties.
Refunds
The Company shall effect a refund of any monies owing to the consumer in respect of the goods and where applicable delivery charges, within 30 days from the date of cancellation of the contract. Such a refund will be subject to any set of monies to which the Company is entitled.
Items lost in the post
It is very rare that Royal Mail or our couriers loose a parcel, however from time to time this does happen. As a rule parcels are not considered lost until after 14 working days. We are not able to process a claim for the parcel until 14 working days have passed from the time of us sending the goods. Once the 14 days have passed we will then process a claim as quickly as possible, however please note the claims process can take several weeks. We do not wait for the compensation to come to us before we refund you or resend the goods but we do have to wait for confirmation that the claim has been accepted. Please understand that in this situation it is not us that have lost the goods and it is frustrating for us also.
Custom Builds
Orders for bikes built to customer’s own specifications may not be cancelled. Any refunds or credits issued to the customer will be entirely at the discretion of Southfork ATB Ltd.
Pricing
All prices are shown in £ sterling. The Company reserves the right to change any advertised prices at any time.
All prices on the site include VAT at the UK standard rate where applicable with UK guides. Price shall mean the consideration due for purchase. Purchasers should note that prices quoted may vary during the currency of brochures (upwards or downwards) and current prices are quoted at the time of order. In respect of orders placed via the Internet, these shall not be accepted by us until confirmed.
All products are subject to availability and may be changed at any time. If your order cannot be fulfilled you will be offered an alternative or given a full refund.
Please note: All Website and Mail Order payments are taken in full at the point of purchase regardless of stock.
Quotations and estimates
Quotations and estimates are given on the assumption that no variation in the price will be made by the manufacturer/ importer and that Government levies remain unaltered. In the event of such changes, the Company reserves the right to amend the quotation or estimate accordingly.
Specifications are advised by the manufacturer, and are subject to change by the manufacturer at any time.
Guarantees/Warranties
All guarantees for products are provided entirely by the manufacturers/UK importers and are subject to terms contained therein. Purchasers are reminded to complete all warranty cards/documents upon receipt of goods where appropriate
Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to the seller for inspection and report (without the seller replacing the said goods prior to such inspection). The purchaser further confirms that it shall be reasonable for the seller to inspect, repair or replace (at its option) such defective goods and allow manufacturers to undertake inspections so as to allow production methods to be modified. The purchaser also accepts that it is reasonable to inform the seller of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow the seller to remedy the defect, failure or interruption. Parts modified or adapted by the purchaser shall no longer be warranted by the manufacturer nor shall the company be liable for any failures resulting subsequent to modification.
"Competition" goods are supplied for specialist use and are subject to extreme wear and stress whilst in use. Life expectancy and durability are greatly reduced and purchasers should note that any claim for failure/wear shall be limited to that of the manufactures guarantees. It is agreed that such use shall be a relevant circumstance for the Sale of Goods Act 1979 (as amended). In addition, parts connected to parts supplied by this company may be placed under stress where specialist/competition parts are used, and purchasers should take advice from experts prior to purchase. Manufacturers may also limit guarantees when components are installed for competition use.
Where modifications or alterations and poor maintenance to goods have been made, the company shall accept no liability for death or personal injury.
Should your product develop a fault whilst still under warranty, please contact us before returning warranty items as some can be sent to the manufacturer direct to speed up turnaround times. However the postage costs to return the product to us will be at your expense.
Delivery
Delivery will usually be within 7 working days, subject to availability, however delivery times are approximate and variable. "Working day" shall mean any day excluding Saturdays, Sundays and public holidays. For out of stock items, delivery dates given are only estimates. We also may deliver the goods in several consignments but will not charge any extra delivery for this.
All our products are shipped by Post Office or courier. The amount you pay will depend upon your delivery address and size and weight of the item. Delivery costs will be clearly stated on the checkout page. The buyer is required to notify the Company, in writing, of any shortage, delivery error or other discrepancy immediately, or at the latest within five days of such failure, thereafter the buyer shall be liable for any such discrepancy. Where delivery is effected to the buyers own delivery contractor, loss or damage in transit claims should be made directly to the carrier. Buyers should retain all packaging in the event of a claim or return within the terms of this agreement.
Title to the product shall not pass to the buyer until the company has received payment in full completing the contract. In the event that sums owing in respect of other items ordered within contract remain due, apportionment by this company shall take place without prejudice to the right to retain title in respect of all goods ordered.
